TERMS OF USE

Scope and validity of the terms

1.1. These terms govern the legal relationship between a person (hereinafter the Customer) and Bios OÜ (hereinafter the Seller), the owner of the online store www.hingepuu.ee (hereinafter the e-store), arising from the purchase of products through the e-store.
1.2. In addition to these terms, legal relationships arising from the purchase of products through the e-store are governed by the legislation in force in the Republic of Estonia.

Products

2.1. Product prices are in euros and include 24% VAT.
2.2. Product prices and availability may change without prior notice.
2.3. Product images in the e-store are illustrative and may differ from the actual products (minimally, and depending on screen settings).

Payment for products

3.1. Products can be paid for via bank links and bank transfer.

Delivery of products

4.1. Products are delivered to the Customer at an Itella SmartPOST parcel locker or by Itella SmartCOURIER to the desired delivery address.
4.3. Delivery by Itella SmartCOURIER within Estonia costs €4.99 in postage per order. Packages are delivered six days a week (Mon–Sat) on the day following the order (except Sundays and small islands). The Customer can choose a suitable delivery time window (9:00–17:00 or 17:00–21:00) and have the goods delivered to work or home.
4.4. Delivery time is 3–5 business days.
4.5. Before placing an order, the Customer must verify the accuracy of the contact details provided, to avoid delays and misunderstandings in delivery. The Seller is not liable for delivery delays or misunderstandings arising from inaccurate or incorrect information provided by the Customer when placing the order.
4.6. The Customer becomes the owner of the goods after payment has been made.

14-day right of return

5.1. The Customer has the right to withdraw from the contract within 14 days of receiving goods purchased from the e-store (hereinafter the 14-day return right), in accordance with the contract terms below.
5.2. By purchasing from the e-store, the Customer agrees to the following conditions for exercising the right of return:
5.2.1. The returned goods must be unused and in their original packaging (the Customer must open the product's original packaging carefully and without damaging it).
5.2.2. To return a product, please complete the withdrawal application, available HERE. The application should be sent to info@hingepuu.ee to arrange further steps. The product can be physically returned via SmartPOST parcel lockers.
5.2.3. We will refund the money for the returned product to the Customer's bank account within 14 days of receiving the withdrawal application. We cover return postage costs within Estonia.

Warranty

6.1. The e-store provides a 2-year warranty on the products sold.
6.2. The warranty does not cover products and parts that are worn, broken due to excessive force, or damaged from being dropped.
6.3. The warranty does not cover parts that have naturally worn out through normal use.

Liability and force majeure

7.1. The Seller and the Customer are liable to each other for damages caused by a breach of these terms, to the extent and in the cases provided for in the legislation in force in the Republic of Estonia.
7.2. The Seller is not liable for damages caused to the Customer or for delays in delivery if the damage or delay is due to circumstances beyond the Seller's control that could not have been foreseen or anticipated (force majeure).

PRIVACY TERMS

8.1. We are committed to protecting the privacy of our customers and users. Accordingly, we have drawn up these privacy policy principles, which address the collection, use, disclosure, transfer, and storage of customer data. Our online activities comply with all relevant European Union legislation and the laws of the Republic of Estonia.
8.2. Collection and use of personal data
8.3. Personal data is data collected by hingepuu.ee to identify or contact an individual. Personal data may be collected, with the customer's consent, in the following ways:
By providing contact details (including your name, postal address, phone number, email address) on our website
Through account information when using the websiteWhen making a purchase or placing an order in our e-store (the e-store may ask users to voluntarily provide personal data and personal information in certain areas of the website. Required personal data may include name, address, postal code, email address, and phone number)
8.4. Using the collected personal data, we can inform customers about hingepuu.ee news, campaigns, and upcoming events. We also use the collected personal data to deliver goods and fulfill obligations to the customer. To better serve the customer, hingepuu.ee may disclose information about individual users to a third party that provides services to hingepuu.ee and is contractually obligated to keep the shared information confidential. An example of such a third party is our partner responsible for transporting goods sold in the e-store.
8.5. Collected personal data can be viewed, changed, and updated on our website under the "My Account" section.

Protection of personal data

9.1. Hingepuu.ee applies all precautions (including administrative, technical, and physical measures) to protect the customer's personal data. Access for modifying and processing data is restricted to authorized persons only.

Security

10.1. All customer personal data obtained during visits to and purchases from the hingepuu.ee e-store is treated as confidential information. An encrypted data connection with banks ensures the security of the buyer's personal data and banking details.

Privacy policy terms and changes

11.1. We reserve the right to amend the privacy terms as necessary. By using our website, we assume that you have familiarized yourself with these principles and agree to them. For any questions or concerns regarding the privacy policy or data processing, please contact us at info@hingepuu.ee.

Complaint procedure

12.1. The online store is liable for any non-conformity or defects in the goods sold to the Consumer that appear within two years from the date the goods were handed over to the Consumer.
12.2. In the event of a defect, the Consumer has the right to contact the online store within two months at the latest, presenting the invoice on the basis of which payment for the goods was made.
12.3. If a defect appears in the goods, please stop using them.
12.4. The repair or replacement of defective goods will be agreed upon between the online store and the Consumer. The online store covers the cost of repair.
12.5. The online store is not liable for defects in the product caused by the Consumer's own fault, resulting from improper storage or use of the product not in accordance with its intended purpose.
12.6. In the event of non-conformity or defects in the product, please send a complaint to info@hingepuu.ee, stating the name of the person who placed the order, contact phone number, order number, and an exact description of the product's non-conformity or defect.
12.7. A complaint regarding non-conformity or defects in the product must be submitted within two months of discovering the non-conformity or defect.
12.8. All complaints will be reviewed and the Consumer will be contacted as soon as possible, but no later than 14 days from receipt of the complaint.
12.9. The Consumer has the right to demand a reduction in the purchase price from the online store, or to terminate the contract and demand a refund for the goods, if the online store is unable to repair or replace the goods, the repair or replacement fails, the online store has not remedied the defect within a reasonable time, or the consumer has been caused unreasonable inconvenience.

Other terms

13.1. If the e-store has refused to resolve the Consumer's complaint, or if the Customer is not satisfied with the solution offered by the e-store and believes that their rights have been violated or their interests harmed, the Customer may file a complaint with the Consumer Disputes Committee through the Consumer Protection Board, or with a court. The Consumer may file the complaint themselves or through a representative. The Consumer Disputes Committee's details are:

13.2. According to the Cemeteries Act, an urn must be buried at a depth of at least 1m within cemetery grounds, which is too deep for the Bios Urn to allow a tree to grow up from it in memory of your loved one. The Cemeteries Act does not apply outside the boundaries of public cemeteries, and the urn is intended for people who do not wish to bury their loved one in a cemetery.
